Following his deportation from the United States of America, Daniel Giersch has been between France and Monaco. The German businessman was made to leave America after his U.S. visa was revoked in 2012.
The last time he was significantly in the limelight was when he won the custody battle over his ex-wife. Right now, Kelly Rutherford’s husband is enjoying seeing his ex-wife travel every now and again to visit their 2 children whom he has sole custody of.
Kelly Rutherford’s Ex-husband was Deported from The United States of America
Daniel Giersch, a German entrepreneur and the husband of American actress, Kelly Rutherford, was deported from the United States in January 2012.
His Visa was revoked by the U.S. after the State Department was tipped off on concerns about his business. These concerns bordered around fraud and possible involvement in dealing with drugs and weapons from South America. The tip-off came from Kelly’s then-lawyer but the actress denied knowing about it.
Upon investigation, the State’s Department found ample reason to revoke Rutherford’s ex-husband’s visa. Kelly’s 50-year-old ex-husband was subsequently banned from re-entering the country.
Consequently, Giersch began to share his time and residents in France and Monaco. It is in either of these countries that you would most likely find the businessman.
Daniel Giersch Has Been Taking Care of his Children, Hermes, and Helena Since he Won Custody of Them
Kelly Rutherford and her ex-husband were in a custody battle for their 2 children, Hermes and Helena since 2008. In fact, Helena wasn’t even born yet when this custody battle started and it tarried for 7 long years.
The final decision of who should take full custody of the children was made in December 2015.
However, backtracking a couple of years, in 2009, Giersch and his ex-wife, the Gossip Girl actress reached an agreement, albeit temporary, that they would share custody. At the time, their first child was 3 years old, and the second was a few months old.
This decision to co-parent remained so for years until May 2015 when the actress was granted temporary sole custody of the children. Prior to this, Hermes and Helena had been living with their father in Monaco since 2012.
A few months after this ruling, Daniel was yet again awarded custody of the kids. Rutherford made a plea and filed a case against the decision but it was ruled out.
By December 2015, the Monaco courts ruled that full custody of Kelly’s children would remain with her ex-husband, Daniel Giersch. She was however permitted extensive visitation rights in France and Monaco and gets to share her input in matters concerning the children.
The wealthy businessman even built a fortress for his children in France, in order to aid their movement from home to school. He later put the house up for sale at 11.5 million pounds.

He Met, Married, and Divorced the Mother of his Kids Within 3 Years
You’d wonder what went wrong within 3 years that would result in such an elongated court battle. We wondered too and so we launched an investigation to lead us from the beginning to when things began to get sour.
The couple – Daniel and Kelly, met in 2005 after the businessman saw Rutherford at an LA restaurant. Daniel sent a waitress working in the restaurant to give the Scream 3 actress his e-mail information whenever she returned there another time.
A few months later, they met and eventually started dating and Kelly even got pregnant almost immediately.
By August 18, 2006, they got married and she gave birth to their first child, Hermes Gustaf Daniel Giersch on October 19, of the same year.
2 years after the birth of their first child, Kelly began to notice changes in her husband. According to her, the German-born techpreneur tried alienating her from her family. He also became verbally abusive and prevented her son from having a U.S. passport.
In spite of the back and forth the couple had, in 2008, she got pregnant again. 2 months in, she filed for divorce from Daniel. The actress accused her ex-husband of cheating on her, hence the divorce. However, court documents cited ‘irreconcilable differences’ as the reason for the divorce.
It was from here that things between the Melrose Place actress and her ex-husband who once sued Google, became messy. Unfortunately, their children Hermes (18) and Helena (16) had to be the center of it all.
